New Senate Bill Aims to Tackle Foreign Robocalls, Including Input from Ecommerce Businesses

Senate Bill 2666 the Foreign Robocall Elimination Act

The Ecommerce Innovation Alliance (EIA) is closely tracking Senate Bill 2666, the “Foreign Robocall Elimination Act,” introduced in the Senate on August 1, 2025 by Senator Ted Budd (R-NC) and Senator Peter Welch (D-VT). This bipartisan bill has been read twice and referred to the Senate Committee on Commerce, Science, and Transportation. Its primary aim is to combat unlawful robocalls, particularly those originating from outside the United States.

The proposed legislation directs the Federal Communications Commission (FCC), in consultation with the Federal Trade Commission (FTC) and the Attorney General, to establish a task force focused on unlawful robocalls. The EIA notes several important aspects of this bill for US ecommerce businesses:

  • Private Sector Representation: The task force will include seven representatives from private sector entities. Crucially, one representative will be from a marketing business that communicates with consumers by telephone as part of its normal operations. This ensures that the perspectives of legitimate businesses, like many in ecommerce that rely on telephone communication for customer engagement and sales, are directly heard.
  • Comprehensive Study on Foreign Robocalls: The task force will prepare a report for Congress and federal agencies. This report is set to examine critical issues, including:
    • Identifying foreign countries that are major sources of unlawful robocalls into the U.S..
    • Determining the financial losses and identity theft resulting from these foreign robocalls.
    • Exploring methods to encourage the adoption of caller identification authentication technology in other countries, and how international collaboration on call authentication can be improved.
    • Assessing if strategies used to combat robocalls can also help address unlawful text messages sent from outside the U.S..
    • Identifying best practices for telephone service providers and technology solution providers to mitigate foreign robocalls.
  • Protecting Legitimate Communications: This bill’s focus on unlawful foreign robocalls, while including legitimate marketing businesses in the task force, aligns with the EIA’s advocacy for common-sense policies that strengthen the ecommerce ecosystem and protect consumer privacy.

The EIA will continue to monitor the progression of Senate Bill 2666 and its potential real-world impact on US ecommerce businesses, particularly regarding telemarketing laws and consumer communication.
