Ecommerce Innovation Alliance Files Lawsuit To Block Texas Senate Bill 140

The EIA announced today that it has filed a "Complaint For Declaratory And Injunctive Relief" in the U.S. District Court for the Western District of Texas. The lawsuit seeks to prevent the enforcement of Texas Senate Bill 140 that made significant changes to the Texas Business & Commerce Code. Most notably, expanding the definition of "telephone solicitation" to include text messages. The EIA is closely tracking Senate Bill 2666, the "Foreign Robocall Elimination Act," introduced in the Senate on August 1st by Senator Ted Budd and Senator Peter Welch. This bipartisan bill has been read twice and referred to the Senate Committee on Commerce, Science, and Transportation.
